When a DOT-regulated employee tests positive, refuses a test, or otherwise violates drug and alcohol regulations, they are immediately removed from safety-sensitive duties. Before they can return to work in a safety-sensitive role, they must complete a specific process outlined in 49 CFR Part 40.
The return-to-duty process requires the employee to be evaluated by a Substance Abuse Professional (SAP), complete any recommended treatment or education, and then pass a return-to-duty drug test with a verified negative result. On Point Drug Testing handles the specimen collection portion — we coordinate with your TPA and the SAP to ensure proper timing and documentation.
